What We Do

What Do Free Legal Aid Crown Court Solicitors Do?

Free Legal Aid Crown Court solicitors manage and conduct your defence at every stage of Crown Court proceedings. From the initial hearing through to jury trial, sentencing, confiscation, and appeal, our criminal defence lawyers prepare your case thoroughly, instruct the right barrister for trial, and ensure your defence is presented to the highest standard.

Preliminary and PTPH Hearings

The Plea and Trial Preparation Hearing is your first appearance at the Crown Court. Your solicitor ensures the indictment is correct, takes your plea, identifies the issues in the case, and begins the case management process that shapes the entire proceedings.

Evidence Review and Case Strategy

Your solicitor reviews every item of prosecution evidence in detail, identifies gaps, weaknesses, and disclosure failures, and builds the defence strategy. We instruct expert witnesses where necessary and prepare defence statements and case management documents.

Barrister Instruction and Briefing

Your solicitor selects and instructs a specialist criminal barrister with the right expertise for your case. We brief the barrister thoroughly, ensuring they understand every detail of your instructions, the evidence, and the defence strategy. See our barristers.

Jury Trial Management

Your solicitor manages every aspect of the jury trial process. We coordinate witness attendance, prepare your evidence, brief you on what to expect, advise on jury selection, and ensure the trial runs smoothly while the barrister advocates in court.

Sentencing and Mitigation

After a guilty plea or conviction, your solicitor prepares compelling mitigation, gathers character references, and instructs psychiatric or pre-sentence reports where appropriate. We argue for the most lenient sentence possible under the Sentencing Council guidelines.

Confiscation and POCA Proceedings

If the prosecution pursues confiscation under the Proceeds of Crime Act 2002, your solicitor defends you against inflated benefit figures, argues for a lower available amount, and challenges the prosecution's financial assumptions. See our POCA defence work.

What Types of Cases Are Heard at the Crown Court?

The Crown Court is the highest criminal court in England and Wales for trial purposes. It deals exclusively with the most serious criminal offences and has unlimited sentencing powers, including the power to impose life imprisonment. Understanding the types of cases heard there helps explain why expert representation is essential.

Cases heard at the Crown Court:

  • Indictable only offences: The most serious criminal charges must be heard in the Crown Court. These include murder, manslaughter, rape, robbery, aggravated burglary, causing GBH with intent, and firearms offences with intent to endanger life. Our Crown Court solicitors have extensive experience defending all of these charges.
  • Either way offences sent for trial: Offences such as theft, ABH, burglary, and drug supply can be sent to the Crown Court if the magistrates decline jurisdiction or the defendant elects Crown Court trial. Your solicitor advises on the best venue.
  • Committals for sentence: If the Magistrates' Court convicts you but considers its sentencing powers insufficient, the case is committed to the Crown Court for sentence. We represent you at the sentencing hearing.
  • Appeals from the Magistrates' Court: If you appeal a conviction or sentence from the Magistrates' Court, the appeal is heard in the Crown Court. Your solicitor prepares the appeal and instructs counsel for the hearing.
  • Confiscation proceedings: Under the Proceeds of Crime Act 2002, the Crown Court can make confiscation orders requiring you to pay back the benefit of criminal conduct. Our POCA solicitors defend these proceedings.

How It Works

How to Get Free Legal Aid Crown Court Solicitors

Securing free Legal Aid representation for Crown Court proceedings involves an application to the Legal Aid Agency. Our criminal defence solicitors handle the entire process for you, from application through to the conclusion of your case.

1

Contact Our Crown Court Defence Team

Call 01582 380938 as soon as your case is sent to the Crown Court, or if you have received a Crown Court date. The earlier we are instructed, the more time we have to prepare. If you are already represented by Woolfe & Co in the Magistrates' Court, the transition to Crown Court representation is seamless. You can also contact us on WhatsApp.

2

Legal Aid Application and Funding

Crown Court Legal Aid requires a means test and a merits test. Your solicitor completes all application forms and gathers the financial evidence required. The Legal Aid Agency will also require a Contribution Order if your disposable income exceeds certain thresholds, meaning you may be asked to contribute towards your defence costs. Your solicitor explains this fully. See our fees and Legal Aid information.

3

Case Preparation, Evidence Review, and Barrister Selection

Your solicitor reviews all prosecution evidence in detail, identifies disclosure failures and weaknesses, takes your full instructions, and builds the defence strategy. We then select and instruct a specialist criminal barrister whose expertise matches your case specifically. Learn about our barristers.

4

Representation Through Trial, Sentencing, and Beyond

Your solicitor manages your case throughout the Crown Court process, attending every hearing, coordinating with your barrister, managing witnesses and evidence, and ensuring your defence is presented properly.
