What We Do

What Do Free Legal Aid Magistrates' Court Solicitors Do?

Free Legal Aid Magistrates' Court solicitors handle every stage of a criminal case in the Magistrates' Court, from the first appearance through to trial, sentencing, and appeal. Our criminal defence lawyers provide full representation at each hearing, ensuring your case is presented properly, your rights are protected, and the prosecution is held to its burden of proof.

First Appearance Representation

Your first hearing is critical. Your solicitor advises on plea, makes bail applications, identifies issues in the prosecution case, and sets the direction of your defence from day one. We ensure you understand the charges and the options available to you.

Bail Application and Variation

Whether you need a bail application, a variation of existing bail conditions, or are facing a breach allegation, our Magistrates' Court solicitors prepare and present the strongest possible case for your liberty.

Case Management and Evidence Review

Your solicitor scrutinises every piece of prosecution evidence, identifies gaps and weaknesses, and prepares the defence. We engage with the CPS on disclosure, case issues, and the possibility of the prosecution offering no evidence.

Magistrates' Court Trial Advocacy

If your case proceeds to trial, your solicitor prepares and presents your defence before the magistrates or district judge. This includes cross-examination of prosecution witnesses, making legal submissions, and presenting your evidence and account.

Sentencing and Mitigation

After a guilty plea or conviction, your solicitor prepares detailed mitigation and argues for the most lenient sentence. We present character references, personal circumstances, and legal arguments to achieve the best possible outcome.

Appeals from the Magistrates' Court

If you have been convicted or received a sentence you wish to challenge, your solicitor advises on and pursues appeals to the Crown Court. We prepare appeal documentation, lodge notices, and represent you at the appeal hearing.

What Types of Cases Are Heard at the Magistrates' Court?

The Magistrates' Court is the busiest criminal court in England and Wales, handling the vast majority of all criminal prosecutions. Understanding which cases are heard there and how they are categorised helps you understand what to expect and why expert representation matters.

Categories of offences at the Magistrates' Court:

  • Summary only offences: These are the least serious offences and can only be heard in the Magistrates' Court. They include common assault, criminal damage under £5,000, most driving offences, disorderly behaviour, and minor public order offences. Our Magistrates' Court solicitors regularly defend these cases.
  • Either way offences: These can be heard in either the Magistrates' Court or the Crown Court. They include theft, burglary, ABH, fraud, and possession of drugs with intent to supply. Your solicitor advises on the best venue for your case.
  • Indictable only offences: The most serious offences must be sent to the Crown Court for trial. However, the first hearing and any preliminary matters including bail take place at the Magistrates' Court. Your solicitor represents you at these critical early hearings.

The Magistrates' Court also deals with youth cases (in the Youth Court), extradition proceedings, and some civil matters. For a full overview of the UK court system, see our guide to the types of courts in the UK.

How It Works

How to Get Free Legal Aid Magistrates' Court Solicitors

Instructing a free Legal Aid Magistrates' Court solicitor is straightforward. Our criminal defence lawyers handle the Legal Aid application from start to finish, so you can focus on your case rather than the paperwork.

1

Contact Our Criminal Defence Team

Call 01582 380938 as soon as you receive a court date or charge. The earlier we are instructed, the more time we have to prepare your defence. If you are already represented at the police station by Woolfe & Co, the transition to Magistrates' Court representation is seamless. You can also contact us on WhatsApp.

2

Legal Aid Assessment and Application

Your solicitor assesses your eligibility for Legal Aid. Magistrates' Court cases require a means test and a merits test. We complete all application forms, gather the necessary financial evidence, and submit the application to the Legal Aid Agency. Many people who assume they do not qualify actually do. Learn about Legal Aid eligibility.

3

Case Preparation and Evidence Review

Your solicitor obtains and reviews all prosecution evidence, takes detailed instructions from you, identifies defence witnesses, and instructs expert witnesses where required. We prepare legal arguments, draft case management documents, and ensure your defence is fully prepared before each hearing.

4

Representation at Every Hearing

Your dedicated Magistrates' Court solicitor attends every hearing with you, from first appearance through to trial and sentencing. We present bail applications, make legal submissions, cross-examine witnesses, present your defence, and advocate on your behalf. If your case is sent to the Crown Court, we continue to act for you and instruct specialist criminal barristers for trial. See our criminal case solicitor services.
