How Is the Youth Court Different From the Adult Magistrates' Court?

The Youth Court is a specialist court within the Magistrates' Court that deals exclusively with children and young people aged 10 to 17. It operates under the Children and Young Persons Act 1933 and the Youth Justice and Criminal Evidence Act 1999. Everything about the Youth Court, from the language used to the sentencing options available, is designed for children and young people.

Key differences from the adult Magistrates' Court:

  • Closed court: The public and press are not admitted. Only those directly involved in the case, including the young person, their parent or guardian, the solicitor, the prosecution, and court staff, are present. This protects the young person's privacy.
  • Parent or guardian must attend: A parent or guardian is required to attend court with the young person unless the court directs otherwise. This reflects the Youth Court's recognition of the family's role in the process.
  • Youth-specific sentencing: The Youth Court uses a distinct sentencing framework including referral orders, youth rehabilitation orders, reparation orders, and detention and training orders. The focus is on rehabilitation and preventing reoffending.
  • Specially trained magistrates: Youth Court magistrates receive specialist training in dealing with children and young people. A district judge may also sit in the Youth Court.
  • Welfare principle: Section 44 of the Children and Young Persons Act 1933 requires every court to have regard to the welfare of the child or young person. This is a statutory duty that does not apply in adult courts.
